New York State recently added Public Health Law Article 13, Title 10, Section 1377 - State Rental Registry and Proactive Inspections to identify lead hazards. This new law requires all properties classified as residential dwellings with two or more units within zip codes of 12303, 12304, 12307, and 12308 in the County of Schenectady built before 1980 to be registered in the New York State Rental Registry by January 2, 2026.
Rental registrations are not transferable to new owners. Upon purchase or transfer of ownership, all new owners must register the change of ownership in the rental registry within 30 days.
Lead is a serious threat to the health of our community, and it is still present in the majority of older houses. Exposure to lead is especially harmful to young children whose bodies are still developing.

Review the draft New York State Lead Rental Registry Program Regulations and the summary of regulations posted in the New York State Register, page 29 on December 24, 2024. The public comment period on proposed regulations will close on February 23, 2025.
The new law seeks to ensure that rental properties are made lead-safe. Each rental unit will need a lead clearance inspection every 3 years. This inspection will include a visual inspection for deteriorated paint and outdoor soil conditions, as well as the collection of dust wipe samples.
