On April 6, 2021, Milton Reyes-Morales [DOB: 10/30/1993] was sentenced based on his plea entered in Schenectady County Court on February 9, 2021. Mr. Reyes-Morales previously pled guilty to one count of Attempted Rape in the First Degree, a class C violent felony and a violation of sections 110.00 and 130.35[1] of the Penal Law of the State of New York in front of Acting Schenectady County Court Judge Mark J. Caruso. The charges stem from Mr. Reyes-Morales sexually assaulting an adult female well known to him, on or about August 4, 2019, at or in the vicinity of 58 Snowden Avenue, in the City and County of Schenectady, New York. The plea to Attempted Rape in the First Degree satisfied a seven [7] count indictment against him.
Mr. Reyes-Morales received a sentence of six [6] years of state incarceration based upon the plea to Attempted Rape in the First Degree to be followed by ten [10] years of parole. Upon his release from prison Mr. Reyes-Morales will be required to register as a sex offender for the remainder of his life. Judge Caruso issued a twenty-four [24] year full order of protection for the victim, meaning Mr. Reyes-Morales is to have no contact with her in any form.
The investigation that led to Mr. Reyes-Morales began with a 911 call placed by a family member of the victim shortly after the assault. Luckily, a Spanish speaking Schenectady Police Officer responded and was able to obtain statements from the victim and her family members about what had just transpired. Based upon those statements. Mr. Reyes-Morales was located at the scene and apprehended.
District Attorney Robert M. Carney stated: “In this case the victim was additionally vulnerable because she was not a citizen. We were able to assist her by advising federal authorities of her cooperation both for her benefit and for all people who may be targeted for harm because of the perception they are powerless.”
The People are represented by Assistant District Attorney John J. Carson. Mr. Reyes-Morales is represented by the Schenectady County Public Defender’s Office. For further information contact Assistant District Attorney John J. Carson at 518-810-7365.
