On February 13, 2024, Robert Miller, [dob: 8/29/1973], a resident of the Town of Niskayuna, pled guilty in Schenectady County Court to one count of Course of Sexual Conduct Against a Child in the Second Degree, a class D violent felony, in violation of New York State Penal Law §130.80. Mr. Miller pled guilty to over a period of longer than three months engaging in two or more acts of sexual contact [touching] with a child less than thirteen [13] years old when he was over the age of eighteen [18]. The repeated acts of sexual contact occurred in the Town of Niskayuna between 2016 and the Summer of 2019. The female child was very well known to Mr. Miller giving him routine unsupervised access to her. Mr. Miller started sexually assaulting her when she was as young as eight [8] years old. The defendant will receive a sentence of seven [7] years in prison, the maximum prison sentence allowed by law for this crime. In addition to the prison sentence based upon the plea agreement, Mr. Miller will serve ten [10] years of post-release supervision, commonly referred to as parole, also the maximum period allowed by law for this crime. Mr. Miller is required to register as a sex offender for the remainder of his life, and a full order of protection for the victim will be issued for twenty-five [25] years. Mr. Miller is scheduled to be sentenced in Schenectady County Court on March 11, 2024.
The investigation into the child sexual assault began on October 23, 2023, when the child was transported to the Schenectady County Child Advocacy Center (CAC) to be forensically interviewed, by Yoni Moskow, a full-time child forensic interviewer employed by the District Attorney’s Office. The CAC is run and staffed by the Schenectady County District Attorney’s Office and is a nationally accredited child friendly environment specifically designed to forensically interview children related to current or past physical or sexual abuse. The child detailed the now several years-old sexual assaults during the forensic interview. Based upon the disclosures, Detectives Paul Daly and Ian Munger of the Niskayuna Police Department interviewed the defendant on November 1, 2023, at his residence. During the interview, Detectives Daly and Munger obtained admissions to the sexual abuse from the defendant both verbally and in a written apology note that Mr. Miller crafted to his victim at the suggestion of the detectives.
